Selling a Rental Property With Tenants in Place

Updated 2026-11-01 · General information, not legal advice.

You can sell a rental with tenants in place. The buyer takes the property subject to existing leases, so review each lease, deposits and notice requirements, and follow your state and local rules. A cash buyer may buy it as-is with tenants.

Read the leases first

Existing leases generally continue after a sale. Note lease end dates, rent amounts, security deposits and any renewal options, and give any notices your lease and local law require.

Vacant vs. tenant-occupied

A vacant house is easier to show and repair but costs you rent while it sits. A tenant-occupied sale keeps rent coming until closing but narrows the buyer pool. Investors and cash buyers are often more comfortable with tenants in place.

Get advice on tenant rules

Tenant protections vary by state and locality. Check with your attorney or local landlord association before you set a closing date or ask tenants to move.
